Draft Prison Rules 2011

CONSULTATION ON THE DRAFT PRISONS AND YOUNG OFFENDERS INSTITUTIONS (SCOTLAND) RULES 2011 HAS NOW CLOSED

Consultation on the Draft Prison Rule 2011 has now closed.  The rules had not been comprehensively reviewed since 1994, although they were consolidated in 2006 to incorporate a number of amendments that had been made between 1994 and 2006.

At this time, the review of the prison rules took over 2 years to complete and involved consultation with a wide range of people including governors, prisoners, criminal justice partners and third sector organisations with an interest in prisons and prisoners families.

The purpose of the review was to:

  • Ensure the Rules continue to comply with the law
  • Reflect current SPS policy and practice
  • To be clearly written

We have also included the 2006 Rules for information, should you wish to refer to both sets.

The Consultation Document outlines the key changes that have been made to the 2006 Rules including modernisation of the language and a change to the sequencing of some parts of the Rules so that they flow more logically.
